An ADU can look straightforward on paper: a detached backyard cottage, a garage conversion, or a suite above a garage. But what affects ADU permit approval is rarely just the floor plan. In the Bay Area, approval depends on whether the design fits the property, the plans answer the building department’s questions, and the project team resolves site constraints before they become corrections.

California has made ADU development more accessible through state law, and many ADUs receive ministerial review rather than a discretionary hearing. That does not mean every plan is approved automatically. The local jurisdiction still verifies compliance with applicable zoning, building, fire, energy, utility, and safety requirements. A clean permit path starts with understanding those requirements before design decisions are locked in.

What Affects ADU Permit Approval Most?

For most homeowners, permit timing and approval come down to three areas: the property itself, the completeness of the construction documents, and the level of coordination between design, engineering, and local agencies. A strong concept can still stall if it overlooks setbacks, fire access, sewer capacity, or a structural issue hidden in an existing garage.

Zoning and the property’s development standards

Your lot is the starting point. Local rules and state ADU standards shape what can be built, where it can sit, how tall it can be, and how it relates to the primary residence. A detached ADU is often the best way to create privacy and long-term flexibility, but it can be more sensitive to site layout. The best solution depends on the project. A conversion may work within existing conditions, while a detached ADU may justify a higher-performance envelope and fully electric systems.

Existing conditions in conversions

Garage conversions and attached ADUs can offer an efficient path to added living space, but existing structures are not automatically permit-ready. The building department may require confirmation that the foundation, framing, slab, roof, walls, and ceiling can support residential use.

A garage slab may lack the moisture protection or elevation needed for a habitable room. Existing framing may not meet current seismic or load requirements. Old electrical panels may have limited capacity. Plumbing routes may be difficult to establish without cutting concrete or reworking part of the main home.

A mature tree near the proposed foundation, trenching route, or construction access path can affect the placement of the ADU and the construction method. Waiting until permit review to address a protected tree can add time and force redesign.
